A 31-year-old resident of Fountain, Colorado, who goes by the name Andrea Serrano, has given birth after having sexual relations with a 13-year-old boy.

She accepted a plea deal on Thursday, March 2, after having been found guilty of sexual assault on a minor. However, according to a report on 11 NEWS, she successfully reached a plea deal with the prosecutors that exempts her from jail time.

As for the current situation involving the victim and his family, the mother of the minor is fighting a custody battle for the child born from the affair.

As per a report by The Gazzette, Andrea Serrano has been accused of being involved with a teenager in inappropriate sexual contact. While the perpetrator was going to face up to 10 years of prison time due to the charges, she has been exempted from it by the plea deal. She is currently on probation and will find out the duration of the same in May this year.

According to KRDO News Channel 13, Serrano was drunk when she had sex with the boy in her car last year. While the means of sustenance for either at the time of the incident have not been disclosed to the public by the authorities, she was reportedly looked up to by the victim as a surrogate maternal figure.

The affidavit of the arrest states that “he (the victim) looked at her (Serrano) like a mother figure and even called her mom before.”

As per the Colorado authorities, the arrest was made on the testimony of a therapist who reportedly discovered sexual intimacy in the relationship between Serrano and the minor.  On being arrested on July 5, 2022, Serrano allegedly confessed to the investigators that the minor had been living with her for several weeks and that she was pregnant with the teen’s child.

Serrano is currently raising the child alone and will need to register herself as a sex offender. She is also facing additional misdemeanor charges on two counts for the supposed violation of a legal protection order, for which she is required to head to the court on March 23.


The victim’s mother’s response

The victim’s biological mother is outraged at the outcome of the plea deal and has stated that, “I feel like my son is robbed of his childhood.”

Mentioning what she claims to be the “double standards” of the court, she also added that “Now he’s having to be a father. He’s a victim, and he’s going to have to live with that for the rest of his life. I feel like if she was a man and he was a little girl, it would definitely be different. They would be seeking more. I feel like because he is not a woman, they are not. They are having compassion for her.”

The Gazette also states that the “lesser charge” against Serrano is that of incest, which stands to be a Class 4 felony in the state.

As per the report from 11 NEWS, the prosecution in court had stated that Serrano had already given birth by 2023. Meanwhile, the victim‘s mother is fighting for the child’s custody, a matter that the court officials said needs to be handled separately.
